TVI FACES ARBITRARY DEPRIVATION OF LIFE, MALICIOUS MISCHIEF AND PHYSICAL INJ...

Zamboanga City, Mindanao, Philippines -The Commission on Human Rights of Western Mindanao has filed a case against TVI Resource Development Philippines a Calgary Canada based mining firm for Arbitrary Deprivation of Life, Malicious Mischief/Physical Injuries of Floro and Manolita Galves, while the respondents have yet to present evidence for their defence.

In a Manifestation with final motion for extension of time filed by company’s lawyer Keneth Rosal dated September 5 said that it received on August 17 this year a Subpoena for Preliminary Investigation issued by the Honorable Commission that the respondents shall file their counter affidavit within ten days from receipt of the subpoena.

But the respondent’s lawyer filed on August 22 an Exparte Motion for additional ten days time extension to submit their counter-affidavits/countervailing evidence until September 8 this year on the ground that its lawyer needs to study the case.

So on September 5, the company through its lawyer filed a second time of motion for time extension due to the in-availability of documentary record to support in their defence.

The complainant Manolita and Floro Galves said that the company as respondent find difficulty producing evidence for their defence in their unauthorized demolition of the farmers. The Galves couple hopes that justice for them will prevail in the near future and the Commission on Human Rights will resolve the case in their favor.

It could be recalled that on June 23 at around 11:45 midnight under the cover of darkness, around 100 company’s SCAA mercilessly and heartlessly demolished the house of Manolita and Floro Galves without authority.

The SCAA bat stroked and mauled Floro Galves several times sustaining several injuries on different parts of his body while other farmers who were hold at gunpoint by the SCAA stood helpless.
